Official Contest Rules

No purchase is necessary to participate or win.

How to Enter.
To enter, complete and submit the online survey located at http://www.tdsway.com/products/recon/win_a_recon. To be eligible for the prize drawing, entries must include entrant's first name, last name and email address. Entrants must complete the entire registration process in order to be eligible to win the prize.

The survey will begin at approximately 12 pm Pacific Time on May 2, 2005. The contest will run until until July 31, 2005. The first and last name provided by online entrants will be the identity of the entrant and, if selected for a prize, the identity of the winner. The use of a bogus name or email address will disqualify an entrant. There is a limit of one entry per email address, per person and/or per family or household. Duplicate entries will be void. By entering an email address, entrant consents to receiving additional TDS promotional information. All entrants agree to abide by these Official Contest Rules. All entries become the property of Tripod Data Systems, Inc. ("TDS").

Eligibility.
All entrants must be at least 21 years of age and a legal resident of the U.S. Employees and immediate families or household members of TDS and its affiliates are not eligible for the survey. TDS is not responsible for any lost, late, illegible, incomplete or misdirected email, any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in the survey.

Selection.
On or about seven (7) days after the survey ends, one winner will be selected at random from all eligible entries received. All decisions of TDS are final and binding on the entrants in all respects. The winner will be notified by email. Odds of winning will be determined by number of entries received. Winners will be given seven (7) business days from the first day of notification to respond to claim prize(s). A non-response by the winner or non-receipt of notification response after the specified seven (7) business days will be considered winner's forfeiture of the prize, and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries.

Prize.
One (1) winner will receive a TDS Recon^TM handheld computer. TDS reserves the right to substitute a prize of equal or greater value. No transfer, change, or cash substitution of the prize is permitted. Unclaimed prize will not be awarded. Other restrictions may apply. Approximate retail value of the prize is $1,299. Entries and prizes are nontransferable. No substitutions are allowed. The winner assumes sole responsibility for all applicable taxes.

General Conditions and Releases.
The contest is void where prohibited or restricted by law in the United States and in all other countries and is subject to all United States and other countries federal, state and local laws and regulations (including United States Export Regulations). All taxes, applicable custom duties and other obligations on the prize are solely the responsibility of the winner.

An entrant or winner may be disqualified from the prize drawing if he or she fails to comply with these official rules, as determined by the sole discretion of TDS.

Unless prohibited by law, entry constitutes permission to use winner's name and likeness in all media for publicity purposes without any further compensation. By entering or accepting a prize in the drawing, winner agrees to be bound by these Official Contest Rules and to conform to all federal, state and local laws and regulations. The winner will be required to execute and return to TDS within 14 days an Affidavit of Eligibility and a Liability and Publicity Release to be eligible for the prize, or an alternate winner will be selected. Winner may be required to furnish proof of identity, address and birth date in order to receive prize.

By entering, participants agree to release and hold harmless TDS, its subsidiaries and affiliated entities, directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability that may arise from their acceptance and/or use of any prize or their participation in this promotion, or from any misuse or malfunction of any prize awarded.

TDS is not responsible for 1) failed, returned or misdirected notifications based on inaccurate information provided by the winner on the entry form or 2) entries and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind. TDS reserves the right, in its sole discretion, to cancel or suspend this survey and prize drawing should a virus, "bug" or other cause beyond TDS' control corrupt the administration, security or proper play of the survey.

Any person attempting to defraud or in any way tamper with this survey will be ineligible for prizes and may be prosecuted to the full extent of the law. TDS reserves the right to modify the rules of the survey in any way or at any time. This survey shall be governed by Oregon law. By participating in this contest, entrants agree that Oregon courts shall have jurisdiction over any dispute or litigation arising from or relating to this survey and that venue shall be only in Benton County, Oregon.

Winner's List.
The name of the winner will be posted on TDS' Web site 10 business days after the winner has been selected and determined eligible to win.
